Solid Fuel Burning Appliance Bylaw No. 1091, 2018

The Council of the Corporation of the Village of Cumberland, in open meeting assembled, enacts as follows:

Citation

  1. This Bylaw shall be cited as “Solid Fuel Burning Appliance Bylaw No. 1091, 2018”.

Definitions

  1. In this Bylaw:

INSTALL means placing and connecting a solid fuel burning appliance within or to a building, and includes removing and reinstalling an appliance in a different location within the same building.

SOLID FUEL BURNING APPLIANCE means an appliance, such as a woodstove, fireplace, furnace, or pellet stove, in which solid fuel is burned and which discharges combustion products.

Appliance Installation

  1. No person shall install, or cause to be installed, a solid fuel burning appliance in any new residential building.

Enforcement

  1. The Manager of Protective Services, Manager of Development Services, Fire Chief, Building Inspector, and Bylaw Enforcement Officer are authorized to administer and enforce this Bylaw.

Severability

  1. If any section or subsection of this Bylaw is found to be invalid by a court of competent jurisdiction, the section or subsection may be severed from the Bylaw without affecting the validity of the remainder of the Bylaw.
